Remedies for Breach of Construction Contract in Foreign Countries Currently, foreign countries applies the FIDIC (“The International Federation of Consulting Engineers) contract model and the NEC (“New Engineering Contract”) contract composed by ICE (“British Institution of Civil Engineers”) Continental laws takes the actual performance of remedies and pursues the value of order.
Thus, the request for the actual fulfillment of the other party is the main concept.[1] France has three related provisions in French Civil Code, and comprehensively defines the response to a breach of contract and the basic qualifications of a legal contact.
So is the German civil code and judges there. [2] On the other hand, Anglo-American Law priorities the request for compensation for damages as the primary remedial measure, because of the convenience in the deal and the efficiency.
And most basically, foreign countries have predefined provisions in construction contract code or civil law, but China does not have such a specialty system to guide and monitor the remedies of the breach of a law.
