Abstract.
Construction contracts in Romania including those for micro-tunneling projects are governed by the provisions of the New Civil Code that became a law in October 2011.
This allocation of risk can be promoted by an independent expert (engineer / project manager / consultant), certifying the correct execution of works, authorize payments, and supervise the fair conduct of both parties involved in the contract.
Project owners, engineers, and construction companies have to anticipate and prevent risks, justify their decisions for interventions and operations, control costs and deadlines, within the context of sustainable development.
